Acceptance of Terms

By downloading, installing, or using the SureTo application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App. These Terms constitute a legally binding agreement between you and Creative Vision LLC ("we," "us," or "our"), an Oregon limited liability company.

Eligibility

You must be at least 13 years old to use the App. By using the App you represent that you meet this requirement. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf.

Description of Service

SureTo is a product safety and ingredient scanning application that provides informational analysis of food and consumer product labels using barcode lookup, optical character recognition (OCR), and third-party ingredient databases. The App is provided for informational and reference purposes only.

Not Medical Advice

The App does not provide medical advice, diagnosis, or treatment. Information provided through the App — including ingredient flagging, additive warnings, allergen alerts, nutritional data, and safety verdicts — is for general informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.

If you have a food allergy, medical condition, dietary restriction, or any health concern, always verify product information directly on the physical product label and consult a qualified healthcare provider before making any dietary or health decision. Never disregard professional medical advice or delay seeking it because of information you received from the App.

Accuracy Disclaimer

The App relies on third-party databases (including Open Food Facts, USDA FoodData Central, and others) which are community-maintained and may contain incomplete, outdated, or inaccurate data. Ingredient label scanning (OCR) results depend on image quality and may be affected by poor lighting, camera angle, motion blur, damaged labels, small print, or reflective packaging.

We make no representations or warranties of any kind, express or implied, regarding the accuracy, completeness, reliability, or suitability of any information provided through the App. Your use of any information obtained through the App is entirely at your own risk.

Recall Alerts Disclaimer

SureTo provides recall alert information sourced from the FDA Food Enforcement database, FDA Drug Enforcement database, and USDA Food Safety and Inspection Service (FSIS) recall database. This information is provided for general awareness only and is subject to the following limitations:

• Recall data is retrieved in real time from third-party government APIs and may be delayed, incomplete, or temporarily unavailable.
• A product displaying no recall alert does not guarantee it is not subject to an active recall. Database coverage is not exhaustive.
• Name-based recall matching is probabilistic — alerts marked "Strong match" or "Possible match" may not apply to your specific product lot, size, or date code. Always verify against the official recall notice.
• Recall status changes (e.g. a recall being lifted) may not be immediately reflected in the app.
• SureTo does not independently verify recall information. All data is sourced directly from FDA and USDA government APIs.

For life-safety food safety decisions, always consult FDA.gov and FSIS.usda.gov directly. Creative Vision LLC is not liable for any harm arising from reliance on recall alert information provided through the app.

Transparency Features Disclaimer

SureTo provides several transparency features including bioengineered food identification, pesticide risk indicators, plant-based detection, and plant protein identification. These features are provided for general informational awareness only and are subject to the following limitations:

• Bioengineered source identification is based on USDA crop prevalence data and ingredient pattern matching. It does not reflect laboratory testing of the specific product and should not be interpreted as a definitive determination that any specific ingredient in the product is bioengineered.
• Pesticide risk indicators are based on EWG Shopper's Guide annual reports and USDA Pesticide Data Program aggregate findings. They do not reflect pesticide residue testing of the specific product lot or batch you are purchasing.
• Plant-based and plant protein detection is based on ingredient text analysis and may not account for all processing methods, cross-contamination, or hidden animal-derived ingredients.
• GMO-derived ingredient detection is based on known GE crop prevalence in the US food supply. Individual products may differ from national averages.

Creative Vision LLC makes no warranty that these transparency features accurately reflect the composition of any specific product. Users with dietary, religious, ethical, or health requirements related to these features should always verify product information directly with the manufacturer.

Limitation of Liability

To the fullest extent permitted by applicable law, Creative Vision LLC and its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, property damage, loss of data, loss of revenue, or any health-related harm arising out of or related to your use of or inability to use the App.

In no event shall our total liability to you for all claims arising out of or related to these Terms or the App exceed the greater of (a) the total amount you paid us in the twelve months preceding the claim, or (b) one hundred dollars ($100).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In those jurisdictions, the above limitations may not apply to you.

Intellectual Property

The App, including its design, code, content, trademarks, and brand identity, is the property of Creative Vision LLC. You may not copy, reproduce, distribute, modify, or create derivative works without our express written permission. Your use of the App grants you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

Subscriptions and Payments

The App offers optional paid subscriptions (Pro and Premium tiers) purchased through Apple's App Store. All payments are processed by Apple. We do not collect or store payment information. Subscription management, cancellation, and refund requests are handled through your Apple ID account settings. Founders Circle memberships are granted at our sole discretion and are non-transferable.

Prohibited Conduct

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse-engineer, decompile, or extract source code from the App
• Use automated tools to scrape or extract data from the App
• Interfere with or disrupt the App's infrastructure or servers
• Impersonate any person or entity in connection with the App
• Use the App in any way that could harm, disable, or impair it

Termination

We reserve the right to suspend or terminate your access to the App at any time, for any reason, with or without notice, including if we believe you have violated these Terms. Upon termination, your right to use the App ceases immediately.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Oregon, and you consent to the personal jurisdiction of such courts.

Data Breach Notification

In the event of a security breach that affects your personal information, we will notify affected users within 30 days as required by Oregon law (ORS 646A.604). Notifications will be sent to the email address associated with your account, if provided.

Your Privacy Rights

If you are a California resident, you have rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information we collect, the right to delete it, and the right to opt out of its sale (we do not sell personal information). To exercise these rights, contact us at support@creativevision.app.

If you are an Oregon resident, you have rights under the Oregon Consumer Privacy Act (OCPA) effective July 1, 2024, including rights to access, correct, delete, and opt out of processing of your personal data.

Non-Affiliation

SureTo is not affiliated with, endorsed by, or sponsored by Open Food Facts, USDA, FDA, or any product manufacturer. References to these organizations reflect data sources only.

No Data Selling

We do not sell your personal information. We do not use third-party advertising trackers. We do not share identifiable scan history with advertisers or third parties for commercial purposes.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the date at the top of this page. Continued use of the App after changes constitutes your acceptance of the updated Terms.
